…. spare a thought for the Canadians who’ve just passed legislation giving the police there somewhat sweeping powers of arrest for drink-driving offences (or not).
The new laws enable the Mounties to get their man whether he’s still in the bar or safely at home.
As a result of Section 253 of the Criminal Code which came into effect last December Canadian police offers can now breathalyse people in their own home up to two hours after they’ve driven a vehicle – so that rules out a drink at home after a long day’s journey then.
What’s more, the onus is now on the driver to prove that they weren’t over the legal limit – 80mg per 100ml of blood – while driving.
The draconian new laws have been criticised by many and while this legislation is likely to be subject to a Federal challenge, any ameliorating amendments could take years to come into force, if at all.
